1. Acceptance of Terms

By accessing or using Onalyst's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Service Description

Onalyst provides AI-powered clinical documentation services including:

  • Ambient audio recording of patient encounters
  • AI-powered transcription and speaker diarization
  • Automated clinical note generation (SOAP notes, referral letters)
  • ICD-10 code suggestions
  • EHR integration capabilities

3. User Responsibilities

As a user of our services, you agree to:

  • Obtain appropriate patient consent before recording
  • Review and verify all AI-generated content before use
  • Maintain the confidentiality of your account credentials
  • Use the service in compliance with all applicable healthcare regulations
  • Not use the service for any unlawful purpose
  • Report any security concerns immediately

4. AI-Generated Content Disclaimer

Important: Onalyst's AI-generated clinical notes and code suggestions are tools to assist healthcare providers. They are not a substitute for professional medical judgment.

  • All AI-generated content must be reviewed by a licensed healthcare provider
  • The provider is responsible for the accuracy of final documentation
  • AI suggestions should be verified before submission to EHR or billing

5. HIPAA Compliance

Onalyst is committed to HIPAA compliance:

  • We will enter into a Business Associate Agreement (BAA) with covered entities
  • All PHI is handled according to HIPAA Privacy and Security Rules
  • We maintain administrative, physical, and technical safeguards
  • Breach notification procedures are in place as required by law

6. Payment Terms

  • Subscription fees are billed monthly or annually in advance
  • Prices are subject to change with 30 days notice
  • Refunds are available within 14 days of initial purchase
  • Cancellation takes effect at the end of the current billing period

7. Limitation of Liability

To the maximum extent permitted by law, Onalyst shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses.

Our total liability shall not exceed the amount paid by you for the services in the twelve months preceding the claim.
